Evans pleaded guilty to a misdemeanor count of obstructing or hindering officers during a civil disturbance and In June 2022, he received a three-month prison sentence. Evans later struck an apologetic tone in fact, knowingly committed a serious crime by confessing under oath in court on January 6, but has since rebranded himself as a “political prisoner” and spread conspiracy theories about the attack he was involved in.
The footage, which Evans broadcast live online on January 6 and was later introduced as evidence at his sentencing, was the most damning evidence against him. It highlighted his third-person bragging about attacking the Capitol, as well as his thoughts and knowledge that his behavior was illegal.

Text messages sent by Evans also show he immediately knew what he was doing was against the law.

Evans’ fundraising emails, with subject lines such as “I spent time in Jail for Trump,” highlight his actions on Jan. 6 as a selling point for his candidacy. One ad even featured stock footage of fake FBI agents sticking their legs out a window, when in reality, the footage showed Evans’ arrest in 2021 being relatively simple.

Miller, who was first elected to the House of Representatives in 2018, is a Trump supporter and tied with him in nearly every vote while in office. Miller was equal He is one of 147 Republicans who voted against confirming Joe Biden’s victory after the Capitol attack. Trump did not vote in Miller’s primary.
Evans was among more than 1,400 defendants charged in connection with the January 6 attack. More than 1,000 defendants were convicted, and more than 500, like Evans, were sentenced to terms ranging from a few days behind bars to 22 years in federal prison.
West Virginia’s 1st Congressional District is solidly Republican, so Miller will be heavily favored to win re-election in the fall.
