Attorneys for Hunter Biden filed nine motions Tuesday asking a judge to dismiss the tax-related charges brought by special counsel David Weiss in California federal court last year.
“The special counsel went to extreme lengths to bring charges against Mr. Biden that would not be brought against anyone else,” Hunter Biden’s attorney, Abbe Lowell, said in a statement. “Prosecutors refused to plea bargains, bowed to political pressure to file unprecedented charges, overreached themselves, ignored rules and allowed their agents to run wild, and repeatedly misrepresented evidence in court to defend their conduct.
In court documents, Hunter Biden’s attorneys argued that the president’s son was being selectively targeted for prosecution. They also claimed statute of limitations and repeated payments for the same tax year.
Hunter Biden’s lawyers claim that the president’s son has already paid his taxes with interest and penalties for one of the tax charges stemming from 2019.
“Criminal tax charges simply do not go away when a taxpayer, like Mr. Biden, pays all he owes under these circumstances,” one of the filings said. “The fact that they were brought here underscores the selective and vindictive persecution of Mr. Biden.”
President Joe Biden’s son has pleaded not guilty to nine tax-related charges accusation in January. He was previously charged with tax evasion in the Central District of California.
The December indictment Hunter claimed that Biden “spent millions of dollars” instead of paying taxes.
The president’s son in December In asking a federal judge in Delaware to dismiss the gun charges against him, he pointed to an earlier deal with prosecutors that his lawyers said gave him immunity.
Several of the motions filed Tuesday echoed arguments in the gun case, but focused more on the specific charges he faces in federal court in California.
