A federal judge on Monday temporarily barred the Department of Education from allowing additional loan forgiveness under the President’s core component. Joe Bidenstudent debt relief plan.
The judge’s decision halted the cancellation of loans under the income-based repayment plan Known as SAVE after several states sued over the program.
U.S. District Judge John A. Ross wrote that the Biden administration was “provided a preliminary injunction against any additional loan forgiveness for borrowers under the Final Rule’s SAVE plan until such time as this Court can decide the case on the merits.”
The Department of Education had no immediate comment Monday evening.
Missouri Attorney General Andrew Bailey, who represents one of the states that filed the lawsuit, welcomed the decision.
“Joe Biden is undermining our constitutional order by trying to saddle working Missourians with Ivy League debt,” Bailey said. “Only Congress has the power of the purse, not the president. Today’s decision was a huge victory for the rule of law and every American that Joe Biden is about to make someone else pay.”
