WASHINGTON – Hunter Biden’s lawyer said in a letter Friday that the president’s son would comply with Congress’ subpoena if House Republicans issue a “new” and “proper” subpoena.
“If you issue a new proper subpoena, now that there is a properly authorized impeachment inquiry, Mr. Biden will respond for a hearing or deposition. We will accept such a subpoena on Mr. Biden’s behalf,” the letter, obtained by NBC News, reads. .

Hunter Biden’s attorney, Abbe Lowell, argued that the subpoenas issued to the president’s son are so far “legally void,” especially since they were issued earlier. The House of Representatives voted to authorize an impeachment inquiry against President Joe Bidenit did so in mid-December.
“I am writing to advise you (if you have not already) that your subpoenas are null and void as a matter of law and that you cannot establish a legal basis to proceed with your misdirected and impermissible contempt resolution,” Lowell said. “And you two, of all people, should know that’s the case.”
Lowell noted in one of the notes to the letter that during Wednesday’s assessment of the Judiciary panel, Rep. Glenn Ivey, D-Md., proposed a hybrid process procedure in which Republicans could hold a public deposition or hearing with alternating questions. Republicans and Democrats, as done in a closed deposition. Four Republicans voted in favor of such a process, Lowell said.
The House of Representatives is set to vote next week to hold Biden in contempt of Congress for failing to comply with subpoenas already issued. He cannot play by a different set of rules. He is not above the law.”
