Fulton County Special Prosecutor Nathan Wade’s former divorce attorney is expected to continue testifying Tuesday afternoon at a hearing regarding the romantic relationship between Wade and District Attorney Fani Willis.
Judge Scott McAfee, who is overseeing the Georgia election interference case against former President Donald Trump and his co-defendants, ruled that some of Wade’s communications with his former attorney, Terrence Bradley, are not covered by attorney-client privilege, according to an email chain. The DA’s office and a defense attorney involved in the case confirmed the authenticity of the emails.
Bradley is expected to testify at a hearing on Tuesday at 2:00 PM ET.
The defendants in the election case alleged that Willis and Wade “enriched themselves from this business” because of their personal relationship. As a result, McAfee said Willis could be barred from continuing the case against Trump and his co-defendants. Willis has denied any wrongdoing and said his relationship with Wade only began after he hired him.
During McAfee held a two-day hearing earlier this month In an affidavit filed by Willis and Wade, Bradley repeatedly said he could not answer questions on the stand because they were covered by attorney-client privilege. McAfee, however, said he would like to meet privately with Bradley and his attorney to discuss the matter further.
Bradley is likely to be questioned about text messages he sent to Ashleigh Merchant, a lawyer for one of Trump’s co-defendants. Merchant suggested that Bradley had personal knowledge that Willis and Wade’s relationship began before Wade was hired as a special prosecutor — something that would contradict their testimony in court.
The DA’s office and Trump’s defense attorney, Steve Sadow, declined to comment. NBC News also reached out to Merchant, who represents Michael Roman, the defendant who first came forward with allegations of involvement with Wade and Willis.
